Terms of Service
Last updated 17 September 2026.
These are the terms for using FirstMate. By signing up, you agree to them.
What FirstMate does
You get a phone number. When you miss a call, our AI assistant answers, tells the caller it's automated, and collects the basics, dates, party size, trip type, contact info, then sends it to you. It can share pricing if you've set it up, but it doesn't confirm bookings or promise availability. Only you do that.
Your responsibilities
Keep your business info accurate. Don't use FirstMate for anything illegal or to harass callers. You're responsible for how you follow up on the leads we send you.
Call recording
Every call is recorded and transcribed, and callers are told this upfront, automatically, as described in our Privacy Policy. Nothing extra required on your end.
Suspending or closing an account
We can suspend or close an account for reasons like nonpayment, abuse, or a terms violation, and we'll tell you why. Most suspensions can be reversed once the issue's resolved. You can close your own account anytime from your account settings, or by emailing support@askfirstmate.com.
No guaranteed uptime
FirstMate relies on outside services we don't control, like phone carriers and AI providers. We work to keep things running, but calls or texts can occasionally fail, and we can't promise 100% uptime.
Limits on our liability
FirstMate is a tool to help you catch leads you'd otherwise miss, not a guarantee that every call is captured perfectly or that a lead turns into a booking. If something goes wrong on our end, our liability is limited to $100, or fees you've paid us in the past 3 months, whichever is greater. We're not liable for lost bookings, lost revenue, or other indirect damages.
Governing law
These terms are governed by the laws of the State of Florida.
Changes to these terms
We'll post updates here, and reach out directly about anything major.
